Elizabeth (Stalker-156) Howard Petition in Equity Madison Circuit Court The plaintiff Elizabeth Howard | that on the 1st Decem 1805 Elisha Hurd was | owner of seventy-two (five crossed out) acres of land lying | Madison Co. on the waters of Silver Cr. and | deed of that date herewith exhibited conveys | said land by metes and bounds to Thomas S | which deed is made a part hereof -- that the said Thomas Stucker took possession of said la | and resided on it until his death about the y | 1809. His wife Martha survived him and died some six years since -- Thomas Stucker | seven children when he died | were his legal heirs namely the plaintiff and | Stucker, Mary Stucker, James Stucker, Nancy Sarah, + Hester -- the family continued in the possession of the land for many years and until long after the plaintiff intermarried with Ignatius Howard in the year 1813. On ab | the 12th of Jany ---- she was then an infant | her 19th year -- that about the month | -ember 1827 the plaintiffs sister Hester | an infant under twenty years of age and | [Note: word NOT probably lost from having had a child or been married | this line} -ted this life intestate leaving the plai | her other brothers and sisters her heirs at | That after the plaintiff married Ignatius Howard she remained his wife and a feme covert until the 20th August 1850 when he departed this life intestate -- That during the lifetime of the said How | | her husband(?) let some person have the plaintiffs | are of said land and the surviving brothers and sisters of the plff sold out their shares -- and the | dants Green Lea and Joel Million are now | ssession of said tract of land and have | for more than two years last past | ving holding and ----ing the right and possesssion thereof | nder the claim to the land divised(?) as afd | no other way. The plaintiff states that she is entitled to her sixth of said tract of land in right of inheritance as afd -- and the defendents hold the other shares as her cotenants in common by title and possession derived from persons who purchased the shares of her brothers and sisters | called on to state the full derivation | possession to the same -- and to | ibit all their evedences of title. She states that she never did any act to impair her right to her one sixth part of the land afd, and that the defts hold the same under some contract made by her late husband not with them but with some person under whom they claim and hold possession directly | indirectly and they are called on to | their derivation of title and possession | his part of the land and to exhibit their | dences of title -- She states that her | husband never had any title to or possession of said land but what he held as her right as above stated -- and that expired at his death -- The defendants are also liable to her for rents since her husbands death -- She desires a partition and for her part to be allotted to her in severlty and for an amount of rents -- She has demanded her rights from the defts and they have refused them and denied her right to any of the land or rents -- Wherefore she prays a judgt for her share of the | and for rents and for whatever else she is | to and for general relief.
