4 JAN 1843 - Rejected Will of Thomas Taylor (Correspondance with William Howard)

I Thomas Taylor of Madison County Kentucky do hearby make my last will and testament in manner and form following that is to say

1st I desire that all the personal part of my Estate be immediatly sold after my Decease and out of the moneys arising thear from all of my Just debts and funeral Expences by paid.

2nd I desire that my Executors hear after named may sell all of my land and Estate and negroes and the moneys arising thear from be Equally divided amongst all of my children naimly Grooms Taylor, Talton Taylor, William Taylor, Gracy Duncan, Ginna Hendren, Benjamine Taylor, Parker Taylor and my wish is for my Deceast daughter Polly Howard's heirs to have her part of my Estat and also my Deceast daughter Rebeca Kidwell's heirs to have hear part of my Estat.

I do hearby appoint William Taylor Guarg___ ent for my daughter ho<?> is _____ Rebeca Kidwell's hirs namly Perry Kidwell, Emberline Kidwell and Polly B. Kidwell and my wish and desire is for my son Benjamin Taylor's part to remain in the hands of my Executors to ishue to him as he may stand in need of hit and at my son Benjamine Taylor deth, the remaining part of his Estat in the hands of my Executors is to be equilly divided amongst his children naimly Rebecca Howard, Smith Taylor, Talton Taylor Jr. and Mary Jane Taylor.

I Desire for Talons Taylor's part and Mary Jane Taylor's part to remain in the hands of my Executors untill they become twenty one years of age and lastly I do hearby costitute and appoint my freiends John Newby and Thomas Taylor Executors of this my last will and testiment hear by revoking all other or former wills or testaments by me heretofore made in witness whereof I here unto set my hand and affix my seal this 4th day of January 1843.

To the honourable the Judge of the Madison circuit court in Chanury proceedings your complainants, Grooms Taylor, Gracy Duncan, Dovin Hendron & Jane his wife, Benjamin Taylor ( Parker ) Taylor, Merryman Howard, Thomas ( Howard ) Posey Kidwell & Polly Kidwell ( ) Richits & Evaline his wife show unto your honour that on the ____ day of ____ 1844 Thomas Taylor Sr. ceparted this life intistate leaving you compts Grooms Gracy Jane Benjamin, Parker Merryman & Thomas, the two latter being the children of Polly Howard a decd daughter of said Thomas and your complainents Posey, Polly and Evaline children of Rebecah Kidwell, a deceased daughter of said intestate -- and Talton Taylor & William Taylor his heirs at law, these two latter are mde defts to thes bill

That said Talton & William have been appointed adms of said intestate and have acted as such -- Intestate left about two hundred and forty five acres of land upon which he resided on the waters of Tates creed in Madison county. He also owned six slaves at his decesase named Squire, America, Dick, Sally Woodson and James and America is likely soon to have another child -- Intestate also left a divers estate in money, personal property & chores in action and was very little indebted if any at his decease. That full time has elapsed for the decsd proper administrations of intestates estate.

The adms mad a sale of most of the personal estate, have used or hired out the slaves & rented out the lands.

Intestate made to his children in lifetime various advancements to some greatly more than to others and they are desirous that the amounts to each shall be ____ & liquidated and that in the settlement of this estate each child may be assigned a proper amount and to that end the ____ are desire to counter plead.

They call on the adms to state & say which money personalty & chores in action of intestates estate come to their hands - what did the personalty sell for - whence was the sale - on what credit was the property sold - what debts was intestate owing who to etc.

That the adms may say what they have rented intestates land for since his death - what slaves did intestate own at ( ____ ) give the names & ages - what has each one hired for since intestates decease.

They charge that the slaves cannot be divided in kind - there not being one for each child - and that it is the desire of all interested that a sale of the slaves should be made as early as possible - & a decree to that effect is asked.

They charge that the land is not worth thirty pounds to the share, that it would ( ____ ) to the interest of all the heirs for a sale of the same to be decreed & it is the desire of all the heirs that such sale should be decreed as early as possible.

Wherefor thy pray your honour to take jurisdiction of their case & to grant them process against the defts & think they maybe summoned to answer this bill on oath & to say what advancements were made to each of them by the intestate, ( ____ ) what ( ____ )

Upon closing they pray for a distribution giving ( ____ )

We agree that no decree need be rendered in the case in the circuit court of T. Taylors heirs except to sell the land & slaves & to divide the money. All other matters are left open - and not to acted on in this case 5th Jany 1845.
